If you are an Australian citizen, your fiance from overseas will need to obtain a Prospective Marriage (Fiance) Visa before the wedding, if you both plan to stay in Australia after the wedding. It can be a wise option to also consult a migration agent for the best approach to suit your individual circumstances.

To do this, you need to lodge a Notice of Intended Marriage with me. This can be signed by your fiance in the presence of an Australian Diplomatic Officer or Australian Consular Officer, a Notary Public, or an employee of the Commonwealth or Australian Trade Commission authorised under the Consular Fees Act 1955. The Notice should then be sent to me. Your fiance will still need to produce original certificates to support the Notice of Intended Marriage. See faqs for more information on paperwork. If these certificates are not in English, an official translation will also be required.

If you fiance cannot conveniently fill in the Notice of Intended Marriage and get in witnessed, then you can complete your section and your fiance can complete the other section when he or she arrives. You will need supporting documentation as well for the notice.

I then supply you with a letter to support the application for a Prospective Marriage (Fiance) Visa, confirming lodgement of the Notice of Intended Marriage and the date and place of the planned ceremony. Please note that there is a fee for this letter.
